Third Sector – Voluntary Activities

The definition of “Third Sector” includes an heterogeneous set of organizations that perform activities and services of public interest, with reasons of solidarity, without obtaining collective and personal, direct and indirect gains, which give it the name of “no-profit sector”.

The Third Sector, since the two remaining concern the State and the Market, is more and more important since it backs the State in the production of services for individuals (social and healthcare, educational, recreational, etc.), envisaged by the law no. 328 of 2000.

The Regional Law no. 11/2007 art. 13 sets forth that persons of the third sector are “those voluntary organizations, social development and support associations and the social cooperation bodies, as well as those private persons with no profit purposes such as foundations, or welfare agencies, those bodies recognised by religions with whom the State made agreements or understanding concerning planning, organization and management of integrated system of social services and interventions, and other social development and support bodies”. 

The bodies of the third sector can join the section A) of the Regional Register established by article 43 and ruled by the Regulation for the implementation. The Voluntary Activity, following the issuing of the framework-law no. 266/91, has historically been the clearest demonstration of social solidarity in the Campania region. Although the solidarity organizations are not enough for the ever changing social world, they became more and more organized and diversified, due to the relevant regional law: first the law no. 9/93, subsequent amendments and additions from no. 18/96, then the no. 11/07 which abrogated the rule no. 9/93 and within its regulation for the implementation (Decree of the President of the Regional Executive Board no. 16/09) re-set the procedure to join the Regional Register of Voluntary Organizations.

The activity of the Sector for Social Policy aims at developing relations and projects with those persons of the Third Sector included in the diversified organized voluntary world, as they are potential stakeholders of the network of services, through the management of the Regional Register of the Voluntary Activity.

As of the month of May 2011, approximately 1400 voluntary organizations are included in the Regional Register.

ADMISSION
The voluntary organizations that have been operating for at least one year on the regional territory can apply for registration along with their supporting documents (see the attached Request to join the register).

RENEWAL
The member organizations shall submit, by 31 December of every two-year period (from the admission year) a request with supporting documents of the valid compliance with the eligibility criteria to join the register (see the attached form). Failure to comply will result in a warning of the relevant Office and, in case of a further negative assessment, in the removal from the register,.
The above mentioned regulation for the implementation of the Regional Law no.11/2007, while renewing the register, envisaged the confirmation, from all associations admitted as for 2009, of all criteria compliance. Those associations that have not fulfilled it yet, shall send a compliance self-declaration (form here attached); failure to comply will result in the removal of the association from the register.
